By using the CheaperThanDirt.com website or placing an order on CheaperThanDirt.com, you agree to the below statements and these Terms of Use.

Customer Affidavit.
By placing an order on CheaperThanDirt.com, you attest that all of the following statements are true:
1. You are not currently less than twenty-one (21) years old.
2. By selling or delivering ammunition and/or firearms accessories to you, CheaperThanDirt.com is not violating any federal, state, or local law or ordinance.
3. You are not under indictment for, and have never been convicted in any court of, a crime punishable by imprisonment for over one (1) year.
4. You are not a fugitive from justice.
5. You are not an unlawful user of, or addicted to, any controlled substance.
6. You have not been adjudicated as a mental defective.
7. You have not been committed to any mental institution.
8. You are not an illegal or unlawful alien.
9. You are not a nonimmigrant alien.
10. You have never been, and you are not expected to be, discharged from the Armed Forces of the United States under dishonorable conditions.
11. You have not renounced your U.S. citizenship.
12. You are currently not subject to a domestic violence restraining order.
13. You have never been, and you are not expected to be, convicted in any court of a misdemeanor crime of domestic violence.
14. You will not conduct an unauthorized export of any defense articles.
Agreement to Indemnify and Defend for Misrepresentation.
If any of the above statements under the “Customer Affidavit” section are untrue, you shall release, hold harmless, indemnify, and pay to defend CheaperThanDirt.com and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys' fees, civil liability, or criminal prosecution.
Email List.
By entering your information to create an account or by placing an order on CheaperThanDirt.com, you authorize us to send you follow-up emails about your purchase and emails with information about other products or services we provide. Your information will be retained and used in accordance with our Privacy Policy. You may unsubscribe from our emails at any time by using the unsubscribe link embedded in one of the emails. We disclaim all liability for any pricing errors in any emails or advertisements we send. All prices shown on our website are final.
Shipping.
At checkout, you will have the opportunity to select a shipping carrier and to designate the address to which you would like your products shipped. This information cannot be changed after you complete checkout. Title to your products will transfer to you once they are delivered to the address you provide at checkout. The shipping carrier’s records are conclusive as to the delivery date and time. Once your products are delivered, you assume all responsibility for them, including the risk that they may be stolen, damaged, or misused. You release us from all liability and responsibility for your products after they are delivered.
Shipping to New York.
Ammunition orders shipped to New York must be shipped to a federal firearms licensee (FFL) or a Registered Seller of Ammunition (RSA), who will perform a state-mandated background check before transferring your ammunition to you. Notwithstanding any contrary language in the “Shipping” section of these Terms of Use, title to your products will transfer to you only after you have passed the state-mandated background check and the products are physically transferred to you by the FFL or RSA, based on the transfer date and time reflected in the FFL or RSA’s records. If you do not pass the state-mandated background check, then we will have the products returned to our warehouse and you will receive a refund of the purchase price minus the original shipping charges, the cost of shipping the order back to our warehouse, and a restocking fee equal to 25% of the total purchase amount.
Shipping Destination Restrictions.
We do not ship outside the United States or to Alaska, Hawaii, California, Massachusetts, Chicago, New York City, or any other area within the United States where we are prohibited by law from shipping product. If you attempt to have product shipped to these restricted areas, your order will be cancelled and you will be charged a cancellation fee of $30.00 or 5% of the total purchase amount, whichever is greater.
Required Documentation.
Ammunition orders shipped to Connecticut, Illinois, New Jersey, and Rhode Island require you to submit certain documentation required by state law before we release your order for shipment. We may validate these documents from time to time. If you attempt to have ammunition shipped to one of these states and fail or refuse to provide the required documentation, your order will be cancelled and you will be charged a cancellation fee of $30.00 or 5% of the total purchase amount, whichever is greater.
Order Cancellation by Customers.
You may not cancel or change your order once it has been submitted. Additionally, for your security, we cannot alter any product information or credit card charges after your order has been submitted.
Order Cancellation by CheaperThanDirt.com.
We may, in our sole discretion, cancel your order if you do not abide by these Terms of Use. If we cancel your order, you will receive a refund of the full purchase amount less a cancellation fee of $30.00 or 5% of the total purchase amount, whichever is greater.
Refusal to Accept Delivery.
By placing an order on CheaperThanDirt.com, you agree to accept delivery of your order at the shipping address designated at checkout. If you fail or refuse to accept delivery of your order, then you will forfeit the full purchase amount, including all taxes and shipping fees, and you will be charged for the cost of shipping the order back to our warehouse. To be clear, you will not receive a refund if you fail or refuse to accept delivery of your order.
Returns of Damaged or Defective Products.
If your products arrive damaged or defective, they may be returned to us within thirty (30) days of your order date for a replacement or store credit. This does not include damage to boxes or packaging – only to the products themselves.

To initiate a return of a damaged or defective product, please e-mail us at customerservice@cheaperthandirt.com so one of our customer service team members can send you a Return Request form to complete. We will not issue a refund for any damaged or defective products that do not have an approved Return Request form on file.

You must complete the Return Request form in full. Any damage must be noted in the form, and you must supply pictures documenting the damage. Once you complete and return the form, we will review it to determine whether, in our discretion, your products are eligible to be returned. If your return is approved, we will send you a pre-paid shipping label so that you can send the damaged products back to us. You are responsible for properly packing and securing your products to protect them from damage during transit back to us.

All returned products are examined upon arrival. Once we receive and examine your return, we will either promptly send you a replacement or issue you appropriate store credit.

If you decide you want the product back after it has been received at our warehouse, we are happy to collect additional payment from you to cover the costs to ship the product back to you.
Returns of Non-Damaged/Non-Defective Products.
Products not covered by the “Returns of Damaged or Defective Products” section above may generally be returned within thirty (30) days of your order date. However, we do not accept returns of ammunition, food, surplus, and clearance/sales products (including, without limitation, any products displayed on https://www.cheaperthandirt.com/sale-items) unless they are damaged or defective at the time they are delivered to you.

To be eligible for a return, non-damaged/non-defective products must still be in their original packaging and may not be used or damaged. Non-damaged/non-defective products that are returned will be subject to a restocking fee equal to 25% of the total purchase amount. Products showing signs of use or damage to the product will be returned to you at your expense, without a refund.

To initiate a return of non-damaged/non-defective products, please e-mail us at customerservice@cheaperthandirt.com to obtain a Return Authorization Number and prepaid shipping label. We will not issue a refund for any products returned to our warehouse that do not have a Return Authorization Number on file.

All returned products are examined upon arrival. Once we receive, examine, and accept your return, we will issue you appropriate store credit. The original shipping charges will not be refunded to you, and any shipping charges incurred in returning the products to us will be deducted from your refund. If you decide you want the product back after it has been received at our warehouse, we are happy to collect additional payment from you to cover the costs to ship the product back to you.
Release of Liability and Agreement to Indemnify and Defend.
CheaperThanDirt.com is a retailer of products that are designed, manufactured, and tested by other companies. We are not be liable for any claims or damages, or for the breach of any warranty, express or implied, whether of merchantability or fitness for any purpose or otherwise, in any way related to any of the products listed on CheaperThanDirt.com.

CheaperThanDirt.com disclaims all liability for the accuracy of information provided to you, and for how you use information provided to you, by CheaperThanDirt.com. CheaperThanDirt.com is not liable for how you or anyone else uses any information received from CheaperThanDirt.com. Therefore, you agree to release, hold harmless, indemnify, and pay to defend CheaperThanDirt.com and its owners, agents, officers, and employees against any damages, including reasonable attorneys' fees, civil liability, or criminal prosecution arising from or related to your use of information provided by CheaperThanDirt.com. You further understand that manufacturers are the best resources for information about their products, including critical safety information. You must review all information and safety warnings from product manufacturers before purchasing and using products from CheaperThanDirt.com.

By placing an order with CheaperThanDirt.com, you agree that you alone are responsible for how the product is used by you or by any other party. You agree to release, hold harmless, indemnify, and pay to defend CheaperThanDirt.com and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys' fees, civil liability, or criminal prosecution arising from or related to the products you purchase, including, but not limited to, the use, storage, or transportation of the products. If any other party files a claim of any kind against CheaperThanDirt.com arising out of or relating to your purchase, use, storage, or transportation of products from CheaperThanDirt.com, you will indemnify and pay to defend CheaperThanDirt.com and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys' fees, civil liability, or criminal prosecution.
Governing Law.
Texas law governs (i) your purchase and use of any products from CheaperThanDirt.com; (ii) any information you receive from CheaperThanDirt.com; (iii) any legal action instituted against you by CheaperThanDirt.com; and (iv) any legal action you institute, or that someone else institutes because of your actions, against CheaperThanDirt.com.
Jurisdiction.
If you choose to file a lawsuit against CheaperThanDirt.com or any of its owners, agents, officers, or employees, that lawsuit must be filed in a court located in Tarrant County, Texas. Any lawsuit filed in any other jurisdiction shall be immediately removed to Tarrant County, Texas, and you must reimburse CheaperThanDirt.com and its owners, agents, officers, and employees for any costs, including reasonable attorneys' fees, they incur in defending a lawsuit or effecting its removal until the lawsuit is properly before a court in Tarrant County, Texas.
Class Action Waiver.
Any litigation between you and CheaperThanDirt.com will be conducted only on an individual basis and not in a class, consolidated, or representative action. By making this agreement, you acknowledge and affirm that this is a knowing, voluntary, and permanent waiver of your right to bring any claims against CheaperThanDirt.com as part of, or on behalf of, any class or any other individuals.
Recording Phone Calls.
We may record and monitor your phone calls with our customer service team. If you communicate with any of our agents or representatives by telephone, you are authorizing us to record and monitor your phone calls with those agents or representatives.
Trademarks and Copyright.
All content on the CheaperThanDirt.com website is copyrighted. The trademark "Cheaper Than Dirt" has been Registered in the U.S. Patent and Trademark Office and is used with permission. All rights are reserved.
